Terms & Conditions at BIGNAMES:// Domain Names & Web Hosting
BIGNAMES will:
1a.) Consider all submitted requests for domain
name registration and accept or reject them in accordance with guidelines
set by Nominet UK.
1.b) Upon acceptance of registration requests submit names for registration
and make full registration upon receipt of payment.
2.) The registrant agrees that all details submitted
in respect of a domain name registration are true and correct and
any alterations made after the initial registration will be also.
3.) Once a registration request has been completed
no refunds will be made by BIGNAMES.
4.) BIGNAMES reserves the right to halt the registration of a domain name if
outstanding monies are owed to them by the registrant.
5.) BIGNAMES process domain registration requests on a first come, first served
basis. Until the registrant receives confirmation of registration
from BIGNAMES there is no guarantee
that the domain name requested will be registered.
6.) BIGNAMES may cancel or halt domain name registrations under certain circumstances,
including; where completing the registration puts BIGNAMES in conflict with guidelines set by Nominet UK ; where BIGNAMES believe that there may be conflicts of rights to a particular name.
7.) BIGNAMES does not accept any responsibility for the use of registered domain
names especially where there may be conflict over rights to ownership.
8.) BIGNAMES will do all they can to ensure that the registrant's details are
submitted correctly during registration. BIGNAMES will not be liable under any circumstances for loss of profit suffered
by the registrant.
9.) The domain name registration period runs
for two years (.uk domain names) or one year (.com, .net, .org)
from the date of registration. After this time period has lapsed,
registration renewal may be made for periods of one or more years
indefinately, upon receipt of payment of renewal fees. NB Depending on the domain name suffix transfer fees may be applicable.
10.) The registrant makes certain to BIGNAMES that the registration of a domain name and the way in which it is
used (directly or indirectly) does not infringe the legal rights
of any third party.
11.) The registrant indemnifies BIGNAMES from any legal proceedings and costs that arise as a result of the
registration of a domain name.
12.) Data submitted by the registrant pertaining
to the registration of a domain name may be available to other organisations
and members of the public.
13.) BIGNAMES reserve the right to make alterations to the terms and conditions
of domain name registration at any time.
14.) Transfers and renewals of domain names
will be made under BIGNAMES Terms and Conditions of Domain Name Registration in force at that
time of renewal or transfer.
15.) BIGNAMES are a webhosting and domain name registration company. We cannot
offer assistance or advice regarding the design of a website. You
should contact a web design company for this type of service.
16.) Hosting and forwarding accounts are payable
anually. No refunds will be made for part years.
17.) BIGNAMESreserves the right to suspend or cancel a customer's access to any
or all services provided by BIGNAMES when BIGNAMES decides that the
account has been inappropriately used or otherwise.
18.) Hosting account holders are not permitted
to resell, store or give away web-hosting services of their website
to other parties. Web hosting services are defined as allowing a
separate, third party to host content on the owner's web site. Exceptions
to this include ad banners, classified ads, and personal ads.
19.) BIGNAMES do not allow any of the following content to be stored on its servers:
Illegal Material - This includes copyrighted works, commercial audio,
video, or music files, and any material in violation of any Federal,
State or Local regulation.
Adult Material - Includes all pornography, erotic
images, or otherwise lewd or obscene content. The designation of
"adult material" is left entirely to the discretion of BIGNAMES.
Warez - Includes pirated software, ROMS,
emulators, phreaking, hacking, password cracking. IP spoofing, etc.,
and encrypting of any of the above. Also includes any sites which
provide "links to" or "how to" information about
such material.
20.) And now for the really heavy legal stuff....
The customer agrees that it shall defend, indemnify, save and hold BIGNAMES harmless from any and
all demands, liabilities, losses, costs and claims, including reasonable
attorney's fees asserted against BIGNAMES ,
its agents, its customers, officers and employees, that may arise
or result from any service provided or performed or agreed to be
performed or any product sold by customer, its agents, employees
or assigns. Customer agrees to defend, indemnify and hold harmless BIGNAMES against liabilities
arising out of; (1) any injury to person or property caused by any
products sold or otherwise distributed in connection with BIGNAMES'
or any third parties' server; (2) any material supplied by customer
infringing or allegedly infringing on the proprietary rights of
a third party; (3) copyright infringement and (4) any defective
products sold to customer from BIGNAMES'
server.
BIGNAMES will not be responsible
for any damages your business may suffer. BIGNAMES makes no warranties of any kind, expressed or implied for services
we provide. BIGNAMES disclaims
any warranty or merchantability or fitness for a particular purpose.
The includes loss of data resulting from delays, nondeliveries,
wrong delivery, and any and all service interruptions caused by BIGNAMES and its employees. BIGNAMES reserves the right
to revise its policies at any time.
21.) These terms and conditions do not affect
your statutory rights as a consumer.
